Question by Nicole: Should I file for bankruptcy? Do I really have another option?
Right now my husband and I are living on his income and private disability through my previous job. We are just making it. My disability runs out in July. I have been rejected for social security disability, which is really common for your 1st attempt in Michigan. I have an attorney to appeal, but I found out that it takes 2 years. This means in 6 months our income after tax will be anywhere from $ 1,500 to $ 1,800 per month. Our student loans, car payments, insurance, healthcare, tools for husband’s job and medication add up to $ 1150 a month. Our rent is around $ 700. Once you add our credit card debt, which is $ 300 a month, we owe $ 2,150 a month. THIS DOESN’T INCLUDE FOOD, GAS, OR DAILY NECESSITIES! I do not see another option than bankruptcy.

Personally,I am most afraid that if we do declare bankruptcy I will lose my wedding ring. It was paid for on one of the credit cards with the highest balance, or I would try to pay that one off right away. I paid $ 2,700 for it. Anyone had any experiences with this, who can share some of the benefits and drawbacks? Can I declare bankruptcy without effecting my husband?
Although, I appreciate money-saving tips, the bottom line is that our bills alone are more than our income, without including groceries, entertainment, etc. Of course there are things we could cut down on, that’s why I have only given information as to what we have to pay every month. We are looking for a cheaper place, but $ 700 includes all utilities. This is a standard rate in our area for 2 people. Public transit is so limited that it is not a realistic option where we live, unfortunately. As far as my health costs. I have written that I am on disability so I don’t I really need to explain those. Those are my out of pocket costs after insurance which I included when calculating our net income.

In some states you can declare bankruptcy without hurting your husband but if his name is on anything it will affect him. I had questions on this because before I met my husband he was not good with money and had a lot of bill, I however had good credit and had my own bills but I pay them on time and so on and his name was not on any of them so it wouldn’t have affected me. I thought about having him file for bankruptcy but it turned out to not be a good idea.

On your student loans you can ask for a deferment on both of them, just call them and tell them your problems, you can’t get out of these loans anyways they will still be there when you file. Also you can try and do a settlement on your credit cards, you need to talk to an attorney and he can help you figure out if bankruptcy is for you. Remember it stays on your credit for 10 years, that’s a long time.

    I don’t see how it would help you much. Are you willing to give up the car? If you are not you will still have those payments, and essentially all that you will be getting out of bankruptcy is having a lower credit card payment. Lets say that goes away entirely; even without that $ 300 going to the credit cards you guys are still looking at more expenses than income. If your monthly income is $ 1500-$ 1800 per month you can not afford to live in a $ 700 per month place, plain and simple.

    Start looking for a cheaper place to live.

    You don’t say what your income is right now or what your credit card balance is. I gather $ 300 is the minimum monthly payment for the credit card. Between now and July you should try to pay off as much of the credit card debt as possible. What kind of insurance do you have? Auto, property, life and/or health? Are the healthcare and medication the full amounts that you pay out of your pocket or are you on a co-payment or deductible plan? If you are still paying off student loans, you and your husband are probably young and I am surprised that medication is a significant expense. Is it really necessary? Is there any way of renegotiating the student loan? Is the car necessary? Could you use public transit? Could the car be traded in for a cheaper used car?

    What kind of monthly bills do you have now that could be lowered? Things like cell phones, cable and internet service add up fast. How often do you eat out or buy expensive convenience foods? Do you rent videos instead of going out to the movie theater? Do you splurge on anything?

    I wouldn’t worry about your wedding ring if I were you. Your financial problems are going to put an enormous strain on your marriage and it’s more important to save the marriage.
